Terms of Use

By using hacking.fashion you agree to these Terms. If you list a brand, the sections for brands apply to you too.

1. Who we are

hacking.fashion is run by [OPERATOR], [ADDRESS] (“we”, “us”). Contact: hello@hacking.fashion.

2. What hacking.fashion is

Two things on one site:

A catalog of independent clothing brands that make their own clothes;
A magazine, including satire.

3. Satire

Articles labelled Satire are fiction written to comment on the fashion industry. Events, quotes and people in them are invented unless stated otherwise. Do not rely on them as fact. Any resemblance to a real person or brand is either coincidence or commentary on public conduct.

4. The catalog

Editorial selection. We decide which brands are listed, based on our published criteria: the brand designs and makes its own clothes, in its own workshop or with a named small producer. We may refuse or remove a listing that does not meet them.
Unclaimed listings. Our editors may add a brand from public sources. Such listings show only public business information and are marked “Unclaimed”. The brand can claim, correct or remove the listing at any time, free of charge (see the Notice & Complaint Handling Policy).
Ranking. By default the catalog is sorted by [DEFAULT ORDER, e.g. date added / alphabetically]; filters sort by country, category, price level and place of production. The weekly Top 7 is chosen by our editors. Payment never affects where a brand appears in the catalog, search or rankings.
No endorsement. A listing is not an endorsement of a brand’s products, and brands are not our partners unless clearly labelled. We do not sell products; purchases happen on brands’ own sites, under their own terms.

5. Listings for brands

Price. A listing costs $40 per year. The first 100 listed brands get their first year free.
Payment. Payments are processed by [PAYMENT PROVIDER], which may act as the seller of record and charge applicable taxes.
Renewal. A paid listing renews automatically each year. We email a reminder at least 7 days before renewal. You can cancel any time; the listing stays live until the end of the paid year.
Refunds. If you cancel within 14 days of a payment, we refund it in full. [Сверить с правилами платёжного сервиса.]
What paying gets you. A complete listing with your photos and texts, updates on request, and a renewal of the listing each year. Paying does not buy a better position, positive coverage, or protection from satire about the industry.
Paid content. Anything we publish in exchange for money or other benefit is clearly labelled as paid.
Your obligations. The information you submit must be accurate and kept up to date. You must have the rights to the images and texts you submit.
Licence. You keep all rights to your content. You grant us a non-exclusive, worldwide, royalty-free licence to display it on hacking.fashion, our apps and our social media to feature your brand, for as long as you are listed and for a reasonable time afterwards in content already published (for example an older article or post).
Removal and suspension. We may remove or suspend a listing that breaks these Terms or the law. We will tell you why and how to challenge the decision, at least 30 days in advance where the law requires and the situation allows.

6. Using the site

You must not:

copy the catalog in bulk or scrape it, except through tools we offer for this;
use the site to send spam or to harass brands or people;
break or overload the site, or try to access parts that are not public;
submit false information or content you have no rights to;
present hacking.fashion content as your own or suggest we endorse you.

7. Our content

Texts, design, illustrations and the hacking.fashion name and logo belong to us or our licensors. You may share links and short quotes with credit. Anything more needs our permission. Brand names and logos belong to their owners; we use them only to identify the brands.

8. Links and third parties

The site links to brands’ websites, Instagram and other services. We are not responsible for their content, products or terms.

9. Disclaimers

We check brands before listing them, but we cannot guarantee that every detail is complete or current, or how a brand’s products will turn out. The site is provided “as is”. Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.

10. Liability

To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to a brand is limited to the amount it paid us in the 12 months before the claim. We do not exclude liability for intent, gross negligence, or death and personal injury caused by negligence.

11. Changes

We may update these Terms. We will post the new version here and, for listed brands, email significant changes at least 15 days before they take effect. If you disagree, you can cancel your listing before then.

12. Law and disputes

These Terms are governed by the law of [COUNTRY]. Disputes go to the courts of [COUNTRY / COURTS], without taking away a consumer’s right to use the courts of their country of residence. Before going to court, please write to us: most problems are solved faster by email.
